Terms of Service
These Terms of Service ("Terms") govern your use of the Walkabout Scorecard mobile application ("the App") operated by Wandering Ghost LLC ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By creating an account or using any part of the App, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy, which is incorporated herein by reference. These Terms constitute a binding legal agreement between you and Wandering Ghost LLC.
2. Description of Service
Walkabout Scorecard is a free mobile application for tracking mini golf scores, match history, and player statistics. The App is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free performance, or permanent retention of your data.
3. Accounts
To use the App, you must create an account. By doing so, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and accept responsibility for all activity under your account.
- Notify us immediately of any unauthorized use of your account.
- Be at least 13 years of age. The App is not intended for use by children under 13.
We reserve the right to suspend or terminate accounts at our discretion, particularly for violations of these Terms.
4. Acceptable Use
You agree to use the App only for its intended purpose and in compliance with all applicable laws. You agree not to:
- Impersonate any person, organization, or entity.
- Harass, threaten, or abuse other users.
- Use automated tools, bots, or scripts to scrape, crawl, or extract data from the App.
- Attempt to reverse-engineer, decompile, or disassemble any portion of the App.
- Attempt to gain unauthorized access to any part of the App or its underlying systems.
- Use the App for any unlawful, fraudulent, or harmful purpose.
- Choose a username that is offensive, misleading, or infringes on the rights of any third party.
5. Intellectual Property
The App, including its design, code, graphics, and content, is owned by Wandering Ghost LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our express written permission.
User-submitted content (such as display names and match data) remains yours. By using the App, you grant Wandering Ghost LLC a limited, non-exclusive, royalty-free license to store, display, and process that content solely for the purpose of providing the App's functionality.
Disclaimer: Walkabout Scorecard is an independent app and is not affiliated with, endorsed by, or sponsored by Walkabout Mini Golf or any of its affiliates. Course names are used for informational identification purposes only.
6. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
We are not responsible for any loss of data, including match history or account information, resulting from technical failures, user error, or circumstances outside our control.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WANDERING GHOST LLC AND ITS MEMBERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
Because the App is provided free of charge, our total liability to you for any claims arising from your use of the App shall not exceed zero dollars ($0.00).
8. Termination
You may stop using the App at any time. You may request deletion of your account by contacting us.
We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the App ceases immediately.
Sections 5 (Intellectual Property), 6 (Disclaimers), 7 (Limitation of Liability), and 9 (Governing Law) shall survive any termination of these Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. You agree that any disputes arising from or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction in those courts.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Your continued use of the App after updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App.
